Terms & Conditions / Session Agreement - The Art & Magic of Santa 2025
What’s included. “Santa Experience” fee of $300 covers one private hour on Kathy’s custom set for up to 3 children, use of studio nightgowns & pajamas, Kathy’s time and artistry, Santa’s fee, and cookies & milk (families with restrictions may bring their own). Magic Ticket invitations are mailed time permitting once booking details and mailing addresses are confirmed.
What’s not included (sold separately). Heirloom Options: artwork, printed products, and digital files are not included in the Santa Experience. Portraits, Storybooks, holiday cards...products may be purchased à la carte after your session.
Booking & payment. Payment is due at booking to reserve your time. Sales tax applies where required.
Rescheduling, cancellations & refunds.
• Full refund if canceled 7+ days before your session.
• Within 7 days: fees are non-refundable. If your child is ill last-minute, we will credit your 2025 payment to a 2026 Santa session if sessions are offered. Credit is non-transferable, has no cash value, and may require travel to Kathy’s home studio if 2026 events are not near your town. We are not obligated to offer 2026 sessions.
• No-shows/late arrivals shorten your session time and are not refundable.
Allergies & food. Cookies and milk are not allergen-controlled. Families with dietary restrictions should bring their own alternatives. We cannot guarantee an allergen-free environment.
Safety & supervision. Parents/guardians are responsible for their children’s safety and behavior at all times on set.
Artwork purchasing. Heirloom Options (portraits, storybooks, holiday cards, etc.) are selected and paid after the session. Because artwork is custom, all sales are final.
Creative discretion. Kathy retains artistic judgment over styling, lighting, posing, and retouching. Color/brightness may vary across screens and prints.
Copyright & usage. Kathy Morley Studio retains copyright to all images. We may elect to display favorite images in studio/website/social—Let us know if you do NOT want us to use your images for marketing purposes.
Force majeure. If events beyond our control (e.g., illness, weather, venue issues) require rescheduling, we’ll offer a new time; our liability is limited to amounts paid.
Governing law. This agreement is governed by the laws of the state of Michigan.
