1. Overview
These Terms & Conditions govern all custom portrait commissions placed with Kathy Morley ("the Artist") through kathymorley.com. By commissioning a portrait, you agree to the terms outlined below.
2. Payment Schedule
All commissions are invoiced in three equal installments:
First payment (1/3 of total): Due at the start of the commission. Work begins once this payment is received.
Second payment (1/3 of total): Due upon your approval of the portrait draft. Final painting begins once this payment is received.
Final payment (1/3 of total): Due upon completion of the finished portrait, prior to shipping.
Payment is accepted via Venmo, Zelle, or personal check.
3. Draft Approval
Before any oil paint is applied to the final canvas, you will receive a digital proof of the portrait composition — including the likeness, setting, and color palette. No final work proceeds until you have reviewed and approved the draft. Your satisfaction with the final result is the Artist's top priority.
4. Cancellation Policy
If you need to cancel your commission, please contact the Artist as soon as possible at kathy@morleyportrait.com.
Cancellation before work has begun: A full refund of your first payment will be issued.
Cancellation after work has begun: The first payment (deposit) is non-refundable, as it covers the Artist's time and resources already invested in your commission.
Cancellation after draft approval: Both the first and second payments are non-refundable. Each situation is unique, and the Artist will work with you in good faith to find a fair resolution.
5. Turnaround Time
Most portraits are completed within 6 to 8 weeks from the start of the commission. Turnaround may vary depending on complexity, the number of active commissions, and revision requests. The Artist will communicate any delays promptly.
6. Shipping
Portraits are carefully packed and shipped to clients across the United States and internationally.
Domestic shipping: Standard domestic shipping costs (typically $20 or less) are covered by the Artist.
International shipping: For international orders where shipping costs exceed a nominal amount, the client is responsible for actual shipping costs. These will be communicated and agreed upon before shipment.
7. Copyright & Reproduction
All artwork created by Kathy Morley remains the intellectual property of the Artist. The client receives a one-of-a-kind original painting for personal display and enjoyment. Reproduction, resale, or commercial use of the artwork without written permission from the Artist is not permitted. The Artist reserves the right to photograph and share completed portraits for portfolio and marketing purposes.
8. Photos Provided by Client
By submitting photographs, the client confirms they have the right to use those images for this purpose. The Artist will use submitted photos solely to create the commissioned portrait.
